Using Discount Traveler. As a condition of your use of Discount Traveler you agree that you will not:

• post any threatening, abusive, defamatory, obscene or indecent material;

• be false or misleading;

• distribute viruses or any other technologies that may harm Discount Traveler or the interests or property of Discount Traveler users;

• impose an unreasonable load on our infrastructure or interfere with the proper working of Discount Traveler;

• copy, modify, or distribute any other person's content without their consent;

• use any robot spider, scraper or other automated means to access Discount Traveler and collect content for any purpose without our express written permission;

• harvest or otherwise collect information about others, including email addresses, without their consent;

• bypass measures used to prevent or restrict access to Discount Traveler.

You are solely responsible for all information that you submit to Discount Traveler and any consequences that may result from your post. We reserve the right at our discretion to refuse or delete or take-down content that we believe is inappropriate or breaching the above terms. We also reserve the right at our discretion to restrict a user's usage of the site ei ther temporarily or permanently, or refuse a user's registration.

“If an establishment or its owners and or managers gets involved in or are part of any activity or dispute or litigation for any reason whatsoever that could in any way possibly tarnish Granadilla Digital Media, Discount Traveler, Bookings-Unlimited, TOP DESTINATIONS AWARDS or any of our sponsors or affiliates  then WE will have the right to either temporarily suspend the listing or alternatively remove the listing from the Discount Traveler or any of our other platforms or competitions Websites”

Abusing Granadilla Digital Media, Discount Traveler. and the Top Destination Awards community work together to keep the site working properly and the community safe.

Without limiting other remedies, we may issue warnings, limit or terminate our service, remove hosted content (Top Destination Awards) and take technical and legal steps to keep users off Discount Traveler if we think that they are creating problems or acting inconsistently with the letter or spirit of our policies. However, whether we decide to take any of these steps, remove hosted content or keep a user off Discount Traveler or not, we do not accept any liability for monitoring Discount Traveler or for unauthorized or unlawful content on Discount Traveler or use of Discount Traveler by users. You also recognise and accept that Discount Traveler is not under any obligation to monitor any data or content which is submitted to or available on the site.

Fees and Services. Using Discount Traveler is generally free, but we sometimes charge a fee for certain services. If the service you use incurs a fee, you'll be able to review and accept terms that will be clearly disclosed at the time you post your ad. Our fees are quoted in South African Rands, and we may change them from time to time. We'll notify you of changes to our fee policy by posting such changes on the site. We may choose to temporarily change our fees for promotional events or new services; these changes are effective when we announce the promotional event or new service.

Our fees are non-refundable, and you are responsible for paying them when they're due. If you don't, we may limit your ability to use the services. If your payment method fails or your account is past due, we may collect fees owed using other collection mechanisms.

Content. Discount Traveler contains content from us, you, and other users. Content displayed on or via Discount Traveler and the Top Destination Awards is protected as a collective work and/or compilation, pursuant to copyrights laws and international conventions. You agree not to copy, distribute or modify content from Discount Traveler without our express written consent. You may not disassemble or decompile, reverse engineer or otherwise attempt to discover any source code contained in Discount Traveler. When you give us content, you are granting us and representing that you have the right to grant us, a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right to exercise the copyright, publicity, and database rights to that content.

Infringement. Do not post content that infringes the rights of third parties, This includes, but is not limited to, content that infringes on intellectual property rights such as copyright and trademark. If a legal representative of the entitled party reports this to us in the correct manner, products infringing on the intellectual property rights will be removed by Discount Traveler.

Liability. You agree not to hold us responsible for things other users post or do.

We do not review users' postings and are not involved in the actual transactions between users. As most of the content on Discount Traveler comes from other users, we do not guarantee the accuracy of postings or user communications or the quality, safety, or legality of what's offered.

In no event do we accept liability of any description for the posting of any unlawful, threatening, abusive, defamatory, obscene or indecent information, or material of any kind which violates or infringes upon the rights of any other person, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any applicable law.

We cannot guarantee continuous, error-free or secure access to our services or that defects in the service will be corrected.

While we will use reasonable efforts to maintain an uninterrupted service, we cannot guarantee this and we do not give any promises or warranties (whether express or implied) about the availability of our services.

Accordingly, to the extent legally permitted we expressly disclaim all warranties, representations and conditions, express or implied, including those of quality, merchantability, merchantable quality, durability, fitness for a particular purpose and those arising by statute. We are not liable for any loss, whether of money (including profit), goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of Discount Traveler, even if you advise us or we could reasonably foresee the possibility of any such damage occurring. Some jurisdictions do not allow the disclaimer of warranties or exclusion of damages, so such disclaimers and exclusions may not apply to you.

Personal Information. We may disclose your personal information to our service providers who are involved in the delivery of products or services to you. We have agreements in place to ensure that they comply with these privacy terms.

We may share your personal information with, and obtain information about you from:

• Other third parties from whom you have chosen to receive marketing information.

We may also disclose your information:

• Where we have a duty or a right to disclose in terms of law or industry codes;

• Where we believe it is necessary to protect our rights.

Opt-out Clause: If you do not wish to receive offers or information from any of our platforms on www.granadillamedia.com whether from Discount Traveler, Bookings-Unlimited or Top Destination Awards, please notify us by sending an e-mail to [email protected]. Due to possible delays, you may still receive promotional material up to 2 months after your notification.

General. These terms and the other policies posted on Discount Traveler constitute the entire agreement between Discount Traveler and you, superseding any prior agreements.

These terms and conditions, as may be amended from time to time, apply to all our services directly or indirectly (through distributors) made available online, through any mobile device, by email or by telephone. By accessing, browsing and using our website or any of our applications through whatever platform (hereafter collectively referred to as the "website") and/or by completing a reservation, you acknowledge and agree to have read, understood and agreed to the terms and conditions set out below (including the privacy statement).

These pages, the content and infrastructure of these pages, and the online accommodations reservation service provided on these pages and through the website (the "service") are owned, operated and provided by Bookings-Unlimited and is provided for your personal, non-commercial use only, subject to the terms and conditions set out below.

Through the website, we (Bookings-Unlimited) provide an online platform through which all types of temporary accommodations (for example Hotels, Game Lodge, Lodge, Country House, Guest House, Bed & Breakfasts, Self Catering, Backpacker and Caravan/Camping collectively the "accommodation(s)"), can advertise their rooms for reservation, and through which visitors to the website can make such reservations. By making a reservation through Bookings-Unlimited, you enter into a direct (legally binding) contractual relationship with the “Accommodation” at which you book. From the point at which you make your reservation, we act solely as an intermediary between you and the “Accommodation”, transmitting the details of your reservation to the relevant “Accommodation” and sending you a confirmation email for and on behalf of the “Accommodation” provider.

When rendering our services, the information that we disclose is based on the information provided to us by accommodation establishment. As such, the “Accommodation” are given access to an extranet through which they are fully responsible for updating all rates, availability and other information which is displayed on our website. Although we will use reasonable skill and care in performing our services we will not verify if, and cannot guarantee that, all information is accurate, complete or correct, nor can we be held responsible for any errors (including manifest and typographical errors), any interruptions (whether due to any (temporary and/or partial) breakdown, repair, upgrade or maintenance of our website or otherwise), inaccurate, misleading or untrue information or non-delivery of information. Each “Accommodation” remains responsible at all times for the accuracy, completeness and correctness of the (descriptive) information (including the rates and availability) displayed on our website. Our website does not constitute and should not be regarded as a recommendation or endorsement of the quality, service level, qualification or (star) rating of any accommodations made available.

Our services are made available for personal and non-commercial use only. Therefore, you are not allowed to re-sell, deep-link, use, copy, monitor (e.g. spider, scrape), display, download or reproduce any content or information, software, products or services available on our website for any commercial or competitive activity or purpose.

4. Extranet

The extranet is free of charge for the first year and thereafter a fee will be asked, we will not charge you for our service or add any additional (reservation) fees to the room rate.

“Accommodation” pay a commission (a small percentage of the room price) to Bookings-Unlimited after the guest has stayed at (and paid) the property.

Payments

The Guest will create a booking and make a direct payment to the “Accommodation” you are required to send confirmation of the reservation to the guest and to Bookings-Unlimited. The extranet must always be updated to avoid double bookings

Accommodation Agreement

The “Accommodation” will be sent the Contract/Agreement with Bookings-Unlimited that will stipulate what our commission fees are and what is expected when making use of the extranet.

Disclaimer

Subject to the limitations set out in these terms and conditions and to the extent permitted by law, we shall only be liable for direct damages actually suffered, paid or incurred by you due to an attributable shortcoming of our obligations in respect to our services, up to an aggregate amount of the aggregate cost of your reservation as set out in the confirmation email (whether for one event or series of connected events).

However and to the extent permitted by law, neither we nor any of our officers, directors, employees, representatives, subsidiaries, affiliated companies, distributors, affiliate (distribution) partners, licensees, agents or others involved in creating, sponsoring, promoting, or otherwise making available the site and its contents shall be liable for (i) any punitive, special, indirect or consequential loss or damages, any loss of production, loss of profit, loss of revenue, loss of contract, loss of or damage to goodwill or reputation, loss of claim, (ii) any inaccuracy relating to the (descriptive) information (including rates, availability and ratings) of the accommodation as made available on our website, (iii) the services rendered or the products offered by the accommodation provider or other business partners, (iv) any (direct, indirect, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, pursuant to, arising out of or in connection with the use, inability to use or delay of our website, or (v) any (personal) injury, death, property damage, or other (direct, indirect, special, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, whether due to (legal) acts, errors, breaches, (gross) negligence, wilful misconduct, omissions, non-performance, misrepresentations, tort or strict liability by or (wholly or partly) attributable to the accommodation or any of our other business partners (including any of their employees, directors, officers, agents, representatives or affiliated companies) whose products or service are (directly or indirectly) made available, offered or promoted on or through the website, including any (partial) cancellation, overbooking, strike, force majeure or any other event beyond our control.

Whether the property you stay at charges you (or has charged you) for your room or per person, or we are facilitating the payment of the room price or per person price, you agree and acknowledge that the property is at all times responsible for the collection, withholding, remittance and payment of the applicable taxes due on the total amount of the room price to the relevant tax authorities. Bookings-Unlimited is not liable or responsible for the remittance, collection, withholding or payment of the relevant taxes due on the room price or per person price to the relevant tax authorities.

By uploading photos/images onto our system (for instance in addition to a review) you certify, warrant and agree that you own the copyright to the photos/images and that you agree that Bookings-Unlimited may use the uploaded photos/images on its website and in (online/offline) promotional materials and publications and as Bookings-Unlimited at its discretion sees fit. You are granting Bookings-Unlimited a non-exclusive, worldwide, irrevocable, unconditional, perpetual right and license to use, reproduce, display, have reproduced, distribute, sublicense, communicate and make available the photos/images as Bookings-Unlimited at its discretion sees fit. By uploading these photos/images the person uploading the picture(s) accepts full legal and moral responsibility of any and all legal claims that are made by any third parties (including, but not limited to, property owners) due to Bookings-Unlimited publishing and using these photos/images. Bookings-Unlimited does not own or endorse the photos/images that are uploaded. The truthfulness, validity and right to use of all photos/images is assumed by the person who uploaded the photo, and is not the responsibility of Bookings-Unlimited. Bookings-Unlimited disclaims all responsibility and liability for the pictures posted. The person who uploaded the photo warrants that the photos/images shall not contain any viruses, Trojan horses or infected files and shall not contain any pornographic, illegal, obscene, insulting, objectionable or inappropriate material and does not infringe any third party (intellectual property right, copyright or privacy) rights. Any photo/image that does not meet the aforesaid criteria will not be posted and/or can be removed/deleted by Bookings-Unlimited at any time and without prior notice
